These Terms of Service ("Terms") are an agreement between you and Vesper ("Vesper," "we," "us"), [BUSINESS ADDRESS]. They cover your use of callvesper.com, our phone numbers, and all calls with Vesper and texts from Vesper (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. What Vesper is — and isn't
1.1 Vesper is an AI. Vesper is an artificial intelligence voice and text companion. It is not a person, and no human is listening live to your calls. Every call begins with the disclosure: "This is Vesper, an AI companion, not a person. This call is recorded."
1.2 Platonic companionship only. Vesper is a friendly, platonic companion. It is never romantic or sexual, and it will decline or redirect conversations of that kind.
1.3 Not medical, mental health, legal, or financial care. Vesper does not diagnose, treat, or provide professional advice of any kind. It is not a substitute for a doctor, licensed professional, or emergency service. Anything Vesper says is for general conversation only, and you are responsible for your own decisions.
1.4 Not an emergency service. Vesper cannot dispatch emergency help. If you are in danger, call 911. If you are in crisis, call or text 988 (Suicide & Crisis Lifeline, U.S.).
1.5 AI can make mistakes. Vesper may sometimes misunderstand or say something inaccurate. Please don't rely on it for facts that matter.
2. Eligibility: adults 18+
You must be at least 18 years old to create an account or call Vesper. Vesper takes incoming calls only; it never calls you. By using the Service, you confirm that you are 18 or older. If Vesper has reason to believe it is speaking with someone under 18, it will politely end the call, and we may suspend the related account or phone number.
3. Your account
3.1 Your phone number is your account. There is no password: calls from your number use your plan, so keep your phone secure. You are responsible for activity on your account.
3.2 Provide accurate information when you create your account.
3.3 One free 15-minute trial call is available per phone number. No payment card is required for the trial.
4. Call recording
Calls with Vesper are recorded and transcribed. By using the Service you consent to this recording. We use recordings and transcripts to provide the Service, to keep the Service safe, to resolve support requests, and to improve quality. See our Privacy Policy for how long we keep them and how to delete them.
5. Calling Vesper
5.1 Call-in only. Vesper is a service you call in to by phone, whenever you like. Vesper does not place scheduled or outbound calls to you.
5.2 Your number. Call from a phone number you own or are authorized to use. Message and data rates may apply.
6. Crisis and safety
If you talk about suicide or self-harm, Vesper will pause the conversation, share the 988 Suicide & Crisis Lifeline, and offer to connect you. Vesper is not a crisis service and cannot guarantee anyone's safety. In an emergency, call 911.
7. Acceptable use
You agree not to: use the Service if you are under 18; use it for anything illegal, harassing, or harmful; try to make Vesper produce sexual, hateful, or dangerous content; impersonate others; record, resell, or redistribute the Service; or interfere with, reverse-engineer, or overload our systems. We may end calls, limit features, or suspend accounts that break these rules.
8. Subscription, billing, and cancellation
8.1 Subscription. Vesper's current price and included call time are listed on our Pricing page. Your subscription includes a monthly allowance of call time, counted by the minute. Unused minutes do not roll over. Employer accounts include a pooled allowance shared across enrolled employees.
8.2 Payments. Payments are processed by Stripe. By subscribing, you authorize us (through Stripe) to charge your payment method at the start of each billing period until you cancel. Prices are in U.S. dollars and exclude applicable taxes.
8.3 Extra call time. You can add extra call time anytime. Extra call time is charged at the price shown at checkout when you add it.
8.4 Cancellation. You can cancel anytime from the Log in page, where we text a secure link to your phone. Your subscription stays active until the end of the paid period, and you won't be charged again. Except where required by law, payments are non-refundable and we don't provide refunds for partial periods or unused minutes.
8.5 Price changes. We'll give you at least 30 days' notice before a price change takes effect on your subscription.
9. Your content
You keep ownership of what you say to Vesper. You give us a limited license to process your content to provide, secure, and improve the Service as described in our Privacy Policy.
10. Service availability
We work to keep Vesper available 24/7, including backup systems if a provider has an outage, but we can't promise the Service will always be uninterrupted or error-free. We may update or change features over time.
11. Disclaimers and limitation of liability
The Service is provided "as is" and "as available." To the fullest extent the law allows, Vesper disclaims all warranties, express or implied, and will not be liable for indirect, incidental, special, or consequential damages, or for any decision you make based on a conversation with Vesper. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.
12. Ending your use
You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these Terms or if we need to for safety or legal reasons.
13. Disputes and governing law
These Terms are governed by the laws of [STATE], without regard to conflict-of-law rules. [Dispute resolution / arbitration clause — lawyer to draft.]
14. Changes to these Terms
We may update these Terms. If a change is material, we'll let you know by email or text, or on our website, before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
